1 Appellant, Richard Campbell, hereinafter referred to as defendant, was charged in Case No. CRF-74-258, in the District Court, Pottawatomie County, with the offense of Murder in the First Degree, After Former Conviction of a Felony, in violation of 21 O.S.Supp. 1975 ? 701.1 [21-701.1]. He waived a jury trial and was convicted by the judge of Murder in the Second Degree. He was given an indeterminate sentence of ten (10) years to Life imprisonment in the State penitentiary. From that judgment and sentence a timely appeal has been perfected to this Court.
